For three months and one day, Richard Pennicuik has been living up a tree.. trying to save it from the chainsaws.

Now, the City of Gosnells says it's had enough.

Today, a letter from the council's lawyers which says:

"The City has now decided to remove the tree and it will do so in due course."

If Richard still refuses to come down, the letter says he'll be charged with obstruction.

The penalty for that offence is a 5 thousand dollar fine and a further 5 hundred dollars for every day thereafter.

The Council still won't say when it plans to pull down the tree, fearing an ugly, dangerous protest.. but today's legal letter gives a strong indication it could be soon.
